Effective Date: August 01, 2026
These Terms & Conditions (“Terms”) govern the commissioning and purchase of hand-drawn maps from Blackpoint Cartography (“Blackpoint,” “we,” “us,” or “our”).
By submitting a commission inquiry, approving a commission, making a payment, or otherwise engaging Blackpoint for a commissioned map, you acknowledge that you have read, understood, and agreed to these Terms.
1. Commissioned Maps
Blackpoint creates individually commissioned, hand-drawn maps based on the geography, scope, details, and direction agreed upon with the client. Each commission is individually produced and may involve substantial time and manual work. Before drawing begins, Blackpoint will provide a digital mock-up or proposed layout for the client to review and approve.
Once the layout has been approved and drawing has commenced, the commission is considered to have entered production.
2. Pricing & Payment
A 50% deposit is required before work begins on a commissioned map.
The remaining balance is due upon completion of the map and before delivery.
Blackpoint may accept payment by electronic funds transfer, Wise, credit card, or other payment methods made available at the time of commission.
A commission is not considered confirmed until the required deposit has been received.
3. Deposits & Cancellation by the Client
Because commissioned maps are custom, individually produced works requiring materials, preparation, and substantial manual labour, the 50% deposit becomes non-refundable once work has commenced. If a client changes their mind, cancels the project, or otherwise chooses not to proceed after drawing has begun, the deposit will not be refunded.
Once production has commenced, Blackpoint is not obligated to provide a refund for a change of mind or a request to discontinue the commission.
4. Design Approval & Revisions
The digital mock-up provided before drawing begins is intended to establish the overall composition, layout, and direction of the commissioned map. The client is responsible for reviewing and approving the proposed layout before drawing begins. Blackpoint does not provide an open-ended revision process after drawing has commenced. Changes requested after production has begun may not be possible and may, at Blackpoint's discretion, require additional work or be declined entirely. By approving the layout, the client acknowledges that the hand-drawn map will be produced based upon the approved direction.
5. Accuracy & Interpretation
Blackpoint maps are hand-drawn cartographic representations created for visual, historical, decorative, and artistic purposes. The maps are not intended to function as navigational charts, surveying documents, engineering plans, or other instruments requiring technical geographic certification. Blackpoint may exercise reasonable artistic and cartographic judgment in determining how geographic information is represented, particularly where the nature of the map requires interpretation, simplification, or visual adaptation.
6. Client-Supplied Information
Clients are responsible for ensuring that information they provide to Blackpoint for the purpose of a commission is accurate and complete to the best of their knowledge.
Blackpoint is not responsible for inaccuracies resulting directly from incorrect or incomplete information supplied by the client.
7. Ownership of the Physical Map
Upon full payment, ownership of the physical original map passes to the client.
Ownership of the physical original does not transfer copyright or other intellectual-property rights in the map.
8. Copyright & Intellectual Property
Blackpoint retains all copyright and intellectual-property rights in commissioned maps unless otherwise agreed to in writing. The purchase of a physical original does not constitute a transfer of copyright. Blackpoint retains the right to reproduce, photograph, publish, display, adapt, modify, and otherwise commercially use the map or elements of the map, including creating prints, editions, derivative works, or other products based upon the design. Where a commissioned map contains highly customized or personalized elements, Blackpoint may modify or adapt those elements when creating future reproductions or derivative works.
9. Prohibited Reproduction & Commercial Use
Without the prior written permission of Blackpoint, the client may not:
• Scan, photograph for reproduction, trace, reproduce, or digitally recreate the map for commercial or other reproductions
• Print or manufacture copies of the map
• Sell, license, distribute, or commercially exploit reproductions of the map
• Create derivative works based upon the map
• Upload the map or a reproduction of it to a service for the purpose of producing commercial copies
• Claim copyright ownership over the map or its underlying design
The client may display and enjoy the physical original for personal purposes, but purchasing the original does not grant a licence to reproduce the map. Blackpoint does not provide digital copies of commissioned maps.
10. Photography & Promotion
Blackpoint retains the right to photograph, reproduce, display, publish, and otherwise use completed commissioned maps, or portions thereof, for portfolio, editorial, promotional, advertising, social media, website, exhibition, and other business purposes.
Blackpoint will not identify the client in connection with a commission unless the client has separately agreed to be identified.
Blackpoint may use portions, details, or photographs of a commissioned map without identifying the client.
No additional compensation is owed to the client for such use.
11. Completion & Delivery
The estimated completion timeline for a commission will be communicated during the commissioning process.
Because each map is individually hand-drawn, production times may vary.
Completion refers to the point at which the physical map has been finished and is ready for framing or delivery.
The remaining balance is due upon completion and before delivery.
12. Framing
Where framing is included in the commission, the map will be professionally framed according to the specifications agreed upon during the commission process. Custom frames and custom size framing is not offered.
13. Shipping
Blackpoint ships commissioned maps to Canada, the United States, the United Kingdom, Europe, Australia, and other destinations where delivery can reasonably be arranged. Shipping methods and carriers may vary based on destination, client preference, availability, cost, insurance, and other practical considerations.
Blackpoint may use different shipping carriers and services at its discretion or at the client's request. International clients are responsible for any applicable customs duties, import taxes, brokerage fees, or other charges imposed by the destination country.
14. Lost Shipments
Blackpoint insures shipments where appropriate. If a commissioned map is lost during delivery, Blackpoint will offer the client one of the following remedies:
• A full refund; or
• A replacement map drawn by Blackpoint.
The available remedy will be discussed with the client based on the circumstances of the loss.
15. Damaged Shipments
If a map arrives damaged during delivery, the client should contact Blackpoint as soon as reasonably possible and provide photographs documenting the condition of the package and map. Where damage is attributable to the delivery process, Blackpoint may offer one of the following remedies, depending on the circumstances:
• Return and re-shipment of the map
• Replacement of the affected map
• Reasonable monetary compensation
Blackpoint may require the damaged map or packaging to be retained or returned for insurance or carrier claims.
16. Client Dissatisfaction
Because commissioned maps are produced according to an approved layout before hand-drawing begins, the client is responsible for reviewing and approving the proposed direction before production begins.
Blackpoint does not guarantee that a client will have no subjective dissatisfaction with the completed map. Where a genuine issue arises concerning a completed commission, Blackpoint will consider the circumstances and may, at its discretion, offer an appropriate resolution.
Nothing in these Terms obligates Blackpoint to provide a refund or remake where the map has been produced substantially in
accordance with the approved commission.
17. Cancellation by Blackpoint
Blackpoint reserves the right to decline or cancel a commission at its discretion.
If Blackpoint cancels a commission after receiving a deposit, the deposit will be refunded to the client in full.
If Blackpoint cancels a commission before receiving a deposit, no refund or other payment will be owed to the client.
18. Circumstances Beyond Our Control
Blackpoint will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including shipping disruptions, carrier delays, natural disasters, government actions, infrastructure failures, or other circumstances that could not reasonably have been prevented. Where such circumstances affect a commission, Blackpoint will make reasonable efforts to communicate with the client and complete or deliver the commission when reasonably possible.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Blackpoint will not be liable for indirect, incidental, consequential, or special damages arising from a commission, delivery, delay, or use of a map. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
20. Changes to These Terms
Blackpoint may update these Terms from time to time. The Terms in effect at the time a commission is accepted will generally govern that commission, unless otherwise required by law or agreed upon in writing.
21. Governing Law
These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada. Any dispute arising in connection with these Terms or a commission will be subject to the applicable courts and laws of Alberta, Canada, unless otherwise required by law.
